  • Uncontested divorces are divorces where the parties agree on the terms of a divorce and the divorce goes through the court system without there being any disputed issues which must be resolved. This can be a much less costly legal procedure than with a contested divorce.
  • Sometimes individuals think they can be divorced on an uncontested basis when in fact their divorce is contested. This is because there may be unresolved issues, such as property distribution, spousal support, child support, child custody and grounds for divorce. In New York, there must be a legal ground for divorce. Without the existence of a legal ground for divorce, the parties cannot be divorced.
